FemTherapeutics Inc. d/b/a femtherapeutics (“femtherapeutics”, “we”, “us”, “our”) provides a platform and services to empower women with pelvic floor conditions with information and resources for personal wellness and care. Our services include access to a digital education platform and products. femtherapeutics is not intended for emergencies or mental health crisis situations. If you are experiencing an emergency should dial 911 immediately and notify and relevant authorities. For mental health crisis situations, dial 988.

Please read these Terms carefully. By accessing or using the Service, creating an account, ordering products, submitting our quiz, or otherwise engaging with femtherapeutics, you agree to be bound by these Terms and all policies incorporated herein by reference. If you do not agree, do not use the Service.

1. Acceptance of Terms and Use

You agree that (a) you are at least 18 years old or using the Service under proper legal supervision; (b) you will use the Service solely in accordance with these Terms; and (c) your use of the Service is subject to any additional terms provided at the point of interaction.

femtherapeutics reserves the right to modify or discontinue any aspect of the Service, with or without notice, and without liability.

2. Definitions

“Service” means femtherapeutics’ website, mobile applications, products, personalized recommendations, and programs delivered through or in connection with Femtherapeutics.
“Account” means a user account you create with femtherapeutics to access the Service.

3. Privacy Policy

Your use of the Service is governed by femtherapeutics’ Privacy Policy, which describes how we collect, use, disclose, and protect your personal information. By using the Service, you consent to the collection and use of information in accordance with the Privacy Policy.

4. Service Description

femtherapeutics provides tools, products, and insights intended to support users’ health and wellness.

You acknowledge that:

  • The Service is not a substitute for professional medical advice, diagnosis, or treatment from a licensed healthcare provider.

  • femtherapeutics does not provide medical care, clinical diagnosis, or prescribe treatment; these activities, where applicable, are performed by independent healthcare provider partners.

5. Account Registration

To use certain features of the Service, you must create an Account and provide accurate, complete, and current information. You are responsible for maintaining the security of your Account and password, all activities under your Account, and for promptly updating registration information.

6. Eligibility and Use Restrictions

The Service is intended for personal, non-commercial use only. You agree not to:

  • Use the Service for commercial purposes, resale, distribution, or unauthorized sharing.

  • Access or use the Service in prohibited ways such as automation, data harvesting, reverse engineering, or unauthorized access attempts.

  • Misrepresent your identity, age, or authority.

Femtherapeutics may refuse, suspend, or terminate access to its Service for any reason, including violation of these Terms.

7. Orders, Billing, and Payment

When you purchase any Service or product:

  • You authorize femtherapeutics to charge your selected payment method for all applicable fees, including recurring subscription charges.

  • All charges are non-refundable except as required by applicable law or as otherwise set in femtherapeutics’ refund policies.

  • You agree to provide a valid payment method and to update payment information upon change.

femtherapeutics does not guarantee submission of charges to third-party payers such as insurers.

8. Intellectual Property

All content and materials provided through the Service, including software, designs, text, graphics, and recommendations (collectively “Materials”), are the exclusive property of femtherapeutics or its licensors, protected by applicable intellectual property laws.

femtherapeutics grants you a limited, non-exclusive, non-transferable, revocable license to use the Service and Materials for personal use only.

9. User Content

If you submit or post any content (“User Content”), you retain ownership but grant femtherapeutics a worldwide, royalty-free, license to use, display, and distribute such content in connection with the Service.

You represent and warrant that:

  • You have all rights necessary to submit User Content;

  • Your User Content does not violate any law or third-party rights;

  • femtherapeutics may remove any User Content at its discretion.

10. Geographic and Legal Restrictions

Due to limitations imposed by law in certain locations, use of our Service or certain features, add-ons, and specific components of Service may not be available to residents of certain states, provinces and territories within the United States and in some international locations.

femtherapeutics does not warrant or guarantee that the Service or the Materials is or will be accessible and/or legally permissible outside of the United States.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. FEMTHERAPEUTICS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FEMTHERAPEUTICS, ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify, defend, and hold femtherapeutics and its affiliates harmless from any claims arising from your use of the Service or breach of these Terms.

14. Termination

femtherapeutics may suspend or terminate your access for any reason, including breach of these Terms, without prior notice. Sections that by their nature should survive termination will remain in effect.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be governed by the laws of [INSERT GOVERNING JURISDICTION], and resolved through binding individual arbitration, unless otherwise prohibited.
